What did the "judges" and their combattants expect? Al Quaeda is an army - built up with US money and advisors (see "Charlie's War"). They are an Army with a military structure of command. So, it is silly to talk about Sheikh Mohammed creating "an atmosphere of intimidation". If anything, it as an atmosphere of "freedom within the soldiers' solidarity".
Let's face it: Guantanamo itself is Intimidation at its worst: coercion, torture, threats at prisoners' families - what worth would anything said there have? Any "confession"? Humbug. Any claim that these were results of "later re-interrogations", i.e. past torture? Rubbish. Once tortured never speaking freely again - not to the persecutors.
And let us not forget: about 140 to 160 former Guantanamo prisoners who were "repatriated" to Afghanitan, were promptlt incarcerated there in 10 minute "trials" on evidence not even the Guantanamo "tribunals" would accept. o, even an acquittal would not mean anything.
But acquittals are not likely. What Sheikh Mohammed has done is justone thing: He blocked the way of pretending "fair trial" by finding a "fig-leaf" here or there for a "non guilty" or "leniency". He re-grouped his platoon, like a good officer, in battle formation.
Once more, this proves: he is a soldier in a war. Mr. Bush himself declared his activities as "War Against Terror". He forgot, like many Americans, that this 9/11 was not the first one - see 1973 in Chile, where terror ruled almighty. But apart from that:
Soldiers actions have to be distingished: are they Acts of War or Crimes of War? This should be tested in an International Court of Justice - BUT: the US have not rcognized that court in The Hague. Why not? I guess, we all know: the whole Bush Cabinet would have to appear there in the Dock. But as things are: We'll be entertained by a wombat trial in a kangaroo court.

Apparently the court knew KSM would do this. Why were the prisoners not charged seperately? One at a time. I understand by the text that there were different charges for each individual. The individuals have a right without threat of retaliation. Yet we put them in a situation that we are fighting a war against. How ironic is that?

This man is a master manipulator, and as such I am amazed that the U.S. Gov't would try all the defendents together. Any phychiatrist could have warned them they would only lose control of the overall situation if they tried them together. (Witness Sadam Hussein's trial). I would like to make a second point: to give this man the death sentence, which he wants, as it will make him a martyr to his cause; would be another major mistake. He should be put in prison, solitary confinement, with a life sentence for every person that died on 9/11. It's hard to be a martyr while you are still alive, eating well, worshiping as you choose and watching color TV in air conditioning (especially when the vast majority of your followers don't have more than 2 of any of the above.

Not sure what the Government was thinking by putting all of them together in one room for the trial. Wouldn't it have been better to try KSM first and convict and work down the line. Now that they've all gotten together after five years no one will provide any information. I don't think a death penalty would be good because it would only make KSM a martyr and further the cause of the terrorists. I would opt for using him in a covert op to lure bin laden out and other key figures. Implant a tracking/homing device and launch a Tomahawk missle taking out KSM and who ever he is meeting with. Big mistake. What did they expect to happen when all the defendants were allowed to be together during their arraignment? Mass confessions? They should have been arraigned seperately and each fed misinformation as to the other defendant's actions. Unless this was the government's plan to secure their conviction by allowing them to voluntarily reject counsel and inadequately defend themselves, I think the more strategtic plan would have been to keep them insulated from each other and more fearful of prosecutors than KSM.

This is one story it's kind of hard to gain an objective perspective on. I certainly am unable to relate to the defendants in their rage against our people and culture. At the same time I can't relate to the position they find themselves within our legal system. If I found myself detained for 5 years in a foreign country in a way which doesn't even measure up to that countries own legal standards, and "interrogated" in manners which disregard international accords, I can't imagine I would have any faith in the legal representative that country assigned to me.

I wonder how surprising it is that these men crumbled under the sway of their leader. On top of the distrust they must have for their lawyers, in order to buy into the brand of hatred KSM and his like are selling they must have been completely brain-washed into not thinking for themselves and just swallowing whatever nonsense their leaders chose to promote.

And don't use standrds tumped up by special interest groups with no official standing, or opinion of foreign organizations that have no standing in this country.Also the story implies, as usual, little knowlege of military courts. The proceedures are a little different, but infinitely more fair than anything he would recieve in any american ,or or that matter, middle eastern court. KSM is currently getting more justice than he probably deserves, but we are a more fair people than we give ourselves credit for. The world laughes at us while we (the media,mostly) wrings it's hand over what said world thinks.

I am often amazed at how inept the military can be. I think it demonstrates the lack of quality in our military leadership that none of them had the remotest idea that bringing all the prisoners into the same courtroom at the same time would not be an opportunity for them to talk and showboat for the press. I'm disgusted by how this was handled. The officers in charge should be court martialed or disciplined and the terrorists should be tried out of sight and out of mind of the rest of us. Do we really care to know what happens to them other than to hear they were executed?

Well, all he needs to do is wait until Obama gets in. Obama will shut Gitmo, import these guys to the US, then, they will get high powered defense attorneys who will get them off on technicalities. At that point, they can go back to do what they love. Killing Americans. Then, Obama and his supporters will call it "the price of Freedom." These AlQuida guys are not dumb. They WANT to use our system against us to destroy us. Thank God Bush fooled them and didn't allow that to happen. He threw them a curve they didn't expect. However, in 8 months, they can get back on track.

Why did not have a muzzle over KSM's face to prevent him from communicating with the other inmates or making speeches? KSM should have been given strict rules about making speeches and such and been tasered as soon as he did something other than make his plea and fire his lawyers. I find it unbelievable that the Bush Admin CONTINUES to screw this case up 5 years later. These defendants should not even been in the same room as each other. Simply unbelievable.

In the very first sentence of this article, the reporter states that KSM is "self confessed". Any other country in the world would have executed this lunatic, and his counterparts, the instant they were captured. Justice is not being served here. The United States tax payer is bearing the financial burden of their incarceration and eventually a trial as well. Additionally, we must pay the salaries of the American soldiers who are representing these contemptible pieces of human trash. I don't know which I find more disgusting- these so called "American" service men and women who are representing them or the bleeding heart liberal mentality of a people that requires them to do so.

A legal system vs. war / military action that is the question . Yes, with out question there must be a rule of law ...even in a military matters .

The matrix of what war is has changed . We as a nation are in a post Viet Nam , WW II era . The "military " forces are not a regular army ..but what we all witnessed on 9/11 ..or did we forget .

Americans to a degree unless you were in NYC , Wash ., D.C. have a selective recall of events. WE were attacked not our military bases but hard working mothers ,fathers ,sons ,daughters , american , non American , white , black, liberal , conservative .

The people , and that is a very liberal word to use for the likes of them , would kill again . Some released at Gitmo found their way to the battle fields again ..only to kill Americans .

Americans forget that for 50 years there was a cold war ..that ended . WE now have a new type of war ..which we did not ask for . With all that said EACH person at Gitmo will have more legal rights , better treatment than any American taken hostage ..Go look at record .

In sum we must ask, :" Is our legal system , laws and justice being used as a tool against us "????

The United States of America is in a state of war . You may have your wide screen TV , BMW , MTV etc ..but make no mistake if given the chance and the ability there are forces in the world that turn the America into a waste land .

With all that said we STILL adhear to the Rule of Law " ..but we should not be fools either !!!

I am relieved to hear they declined the appointed legal counsel. They will be unable to represent themselves as well. I am also relieved for those who would have been appointed. Can you imagine if the justice system made a mistake and our soldiers had to get the case thrown out? They would feel terrible and suffer for life here in the states for merely doing their job.
